Insolvency Practitioners
TressCox works with insolvency practitioners in all types of external administration of corporations to assist in maximising the chances of the company, or as much as possible of its business, continuing in existence or if that is not possible to produce the best return for the company’s creditors and members.
Whether it be receivership, administration, provisional liquidation or liquidation we provide advice prior to the appointment and during the administration on all issues arising. In particular we advise on which form of appointment is appropriate in the circumstances.
In the case of personal insolvencies we work with trustees in bankruptcy to unravel complex financial structures to maximise return to creditors.
Stakeholders
We also advise, assist and take appropriate action for creditors, shareholders, guarantors and directors on the many and varied issues which may confront them during an insolvency.
Commercial
Our extensive experience includes not only advising on but preparing commercial documentation to implement solutions to problems as they arise.
We work with insolvency practitioners and corporate stakeholders to develop and implement corporate reorganisation and reconstruction. This will vary from a simple Deed of Company Arrangement to the more complex Deeds, Schemes of Arrangement and Creditor Trusts.
Litigation
Our team is experienced in all types of litigation arising in the insolvency context. These may be routine winding up applications, appointments of provisional liquidator, applications to the Court for directions for an insolvency practitioner, pursuing preference claims or insolvent trading claims, applications to extend convening periods, and a myriad of other types of litigation.
