Some of our more interesting matters include:

  • Representing the Australian and South East Asian operations of a multi-national media company  - advising on, and drafting recording artist agreements, joint venture agreements, licence and distribution agreements for both music and audio-visual products.
  • Representing a multi-national company which owns many well known household brand products – advising on  intellectual property matters including reviews of packaging and advertising material, brand protection advise, negotiation and drafting of  licences and assignments of various intellectual property rights, protection and enforcement of these rights by way of litigation or alternative dispute resolution.
  • Comprehensive advice for a large publishing group in respect of Australia’s parallel importing laws for books.
  • Strategy for, and establishment of, corporate and legal structures for acquisition of rights in television programs and other content for the production of a range of Pay TV channels.
  • Implementation of an appropriate strategy for the registration and protection of domain names for a major multi-national media company including the integration of the strategy with its trade mark management.
  • Acting for owners of sound recording in proceedings against importers and retailers of bootleg and pirate albums.
  • Acting for music publishers alleging unauthorised use of songs in soundtracks and advertisements.
  • Acting for international artists and their merchandising companies (including U2, Madonna, The Rolling Stones, ACME T-Shirts and Brockum Merchandising) in actions to prevent sales of bootleg merchandise at retail and concert venues.  We were the first firm in Australia to obtain a ‘John Doe’ order preventing sales of unauthorised merchandise at concert venues.
  • Management and implementation of brand and character merchandise protection programs on behalf of various international trade mark owners.  These include surveillance of the marketplace, filing and maintenance of Customs’ Notices, liaising with Customs on seizures of illegal imports and servicing appropriate notice upon infringers.
  • Conduct of patent litigation for patent owners and alleged patent infringers in regard to patents for industrial fans, poker machines, building products and engineering equipment.
