TressCox 'Insurance Contracts Act' Seminar Series 2010 - Part 4

We are delighted to invite you to the fourth seminar in  our 'Insurance Contracts Act' Seminar Series for 2010.

In March 2010 TressCox launched the ‘Insurance Contracts Act’ Seminar Series to provide you with a practical overview of the Insurance Contract Act. The series will include;

  • A review of Sections 40 and 54 of the Insurance Contact Act
  • Insights into the duty of utmost good faith
  • Duty of disclosure
  • Expiry, renewal and cancellations
  • Subrogation and contribution between insurers

In the first seminar presented by Alistair Little, head of the TressCox Sydney, Litigation Division, the audience was provided with an overview of the Insurance Contracts Act, its application and the role of ASIC in the wake of the GFC.

The second seminar in May, presented by Rina Sheftalovich, a Senior Associate in Sydney’s Litigation Division focused on the duty of utmost good faith under the Insurance Contracts Act, as well as considered the application of the traditional common law doctrine of the duty of utmost good faith and also reviewed recent leading cases in this area.

The third seminar in July was presented in Sydney by Mark Sheller and in Melbourne by Jason Newman, both Partners in our Litigation Division.  The seminar focused on the duty of disclosures, consequences of breaches of duty of disclosure or misrepresentation of prior known claims exclusions.

The fourth seminar is scheduled to take place on Tuesday 21 September 2010 in Sydney and on Thursday 23 September 2010 in Melbourne.

The dark horse of the Insurance Contracts Act, section 54, is arguably the most relevant provision and is applicable to all levels of the insurance industry. In this fourth seminar Marini Mann, a lawyer in our insurance group, will provide a practical understanding of the operation of section 54 and its relationship to section 40, including fraudulent claims.
